1. INTRODUCTION
This document sets out the privacy policy of Trio Commerce Pty Ltd ABN 36 671 764 113 (referred to in this privacy policy as ‘we’, ‘us’, or ‘our’).
This Privacy Policy explains how we collect, use, store, disclose and handle personal information in connection with:

  1. our Shopify application known as AdRelate (App);

  2. the Shopify App Store listing for the App;

  3. our website, if any;

  4. related support and technical services; and

  5. any related products or services we provide.


We are an Australian business and handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth).
Our App is primarily intended for Shopify merchants located in Australia, the United States, Canada and other international jurisdictions.The App may be accessible internationally and certain international privacy laws, including aspects of the General Data Protection Regulation (GDPR), may apply in some circumstances.Accordingly, we have incorporated certain internationally recognised privacy and data handling principles into our practices to support cross-border operations and international users.
By installing or using the App, you acknowledge that your information may be collected, processed, stored and transferred in Australia and other countries where our service providers, infrastructure providers, technology providers operate.
This Privacy Policy also explains our use of cookies, pixels and similar tracking technologies.
We take our privacy obligations seriously and we’ve created this privacy policy to explain how we store, maintain, use and disclose personal information.

  4. technical information, including IP address, browser type, operating system, device identifiers, session information and diagnostic logs;

  5. communications and support information submitted through support requests, emails, feedback forms or other correspondence;

  6. subscription and billing information made available through Shopify’s billing systems;

  7. marketing and communication preferences; and

  8. any other information voluntarily provided to us.

We do not intentionally collect sensitive information through the App.

  4. order-related information;

  5. storefront interaction data; and

  6. other Shopify data reasonably required for the functionality of the App.

 

We only access and use this information for the purposes of providing, maintaining and improving the App and related services.
 

We comply with Shopify’s applicable data handling and privacy requirements, including mandatory data access, redaction and deletion requests required under Shopify’s platform policies and webhook requirements. Shopify also independently collects, processes and handles information in accordance with its own privacy policies and platform terms, which may be accessible from here. We encourage merchants and users to review Shopify’s privacy policy and related platform documentation to understand how Shopify handles personal information and storefront data

6. USE OF YOUR PERSONAL INFORMATION

We collect and use personal information for the following purposes:

  1. to provide, operate and maintain the App and related services;

  2. to generate analytics, recommendations and landing page functionality within the App;

  3. to provide customer support and technical assistance;

  4. to process subscriptions and billing;

  5. to communicate with you regarding service updates, security notifications, billing matters and support requests;

  6. to improve the functionality, performance and security of the App;

  7. to troubleshoot technical issues and maintain service reliability;

We may also use aggregated, anonymised or de-identified usage information to improve the App, its functionality and related automated systems.

8. COOKIES, PIXELS AND TRACKING TECHNOLOGIES

We use cookies, pixels, analytics tools and similar technologies in connection with the App, our website and merchant storefront integrations.

The App may install tracking or analytics functionality within a merchant’s Shopify storefront as part of the App’s standard functionality.

However, storefront analytics or tracking data is only collected where the merchant has implemented appropriate consent mechanisms within their storefront and an end user has provided any consent required under applicable laws for analytics or tracking technologies.

Merchants are responsible for configuring and managing their own storefront privacy, cookie consent and compliance settings, including any consent banners or tracking permissions required under applicable laws.

We do not independently control or override a merchant’s storefront consent settings.

Information collected through these technologies may include:

  2. browser and device type;

  3. session identifiers;

  4. geolocation information;

  5. pages viewed;

  6. referral URLs;

  7. interactions with storefront content; and

  8. general analytics and performance data.

9. TYPES OF COOKIES WE MAY USE

  1. Strictly Necessary Cookies: these cookies are required for the operation, security and functionality of the App and related services.

  2. Performance and Analytics Cookies: these cookies help us analyse usage trends, improve App functionality and better understand how users interact with the App and storefront experiences.

  3. Functional Cookies: these cookies remember user preferences and improve user experience and App functionality.

Analytics and Attribution Technologies: these technologies may assist merchants in measuring storefront performance, analytics, attribution and user interactions where appropriate customer consent has been obtained through the merchant’s storefront configuration.The App does not independently implement customer-facing consent banners or override merchant privacy settings.

You can generally control cookies through your browser settings. However, disabling cookies or tracking technologies may affect the functionality or performance of the App or related services.

10. SUPPORT COMMUNICATIONS AND MARKETING

 

We may use your contact information to:

  1. provide customer support;

  2. respond to technical issues and enquiries;

  3. send service-related notices, billing communications, security alerts and administrative updates; and

  4. send marketing or promotional communications relating to the App and related services.

 

You may opt out of receiving marketing communications at any time using the unsubscribe functionality included in those communications or by contacting us directly.

 

Service-related and administrative communications may still be sent where reasonably necessary for the operation of the App or your Subscription.

11. TECHNICAL LOGS

 

We may collect and retain technical log information relating to use of the App for troubleshooting, security, fraud prevention, system integrity and service reliability purposes.

 

Technical log information is retained only for as long as reasonably necessary for those purposes.

12. SECURITY

We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our information technology systems are password protected, and we use a range of administrative and technical measures to protect these systems. However, we cannot guarantee the security of your personal information.

13. DATA BREACHES

Where required under applicable laws, including the Australian Privacy Act 1988 (Cth) and, where applicable, the GDPR, we may notify affected individuals, merchants and/or relevant regulators of eligible data breaches within applicable legal timeframes.

 

Merchants remain responsible for assessing and complying with their own legal obligations relating to data breaches affecting information collected through their storefronts or systems.

14. INTERNATIONAL USERS AND CROSS-BORDER TRANSFERS

Our business is based in Australia, however the App may be used by merchants and end users located in multiple international jurisdictions, including the United States, Canada, the European Economic Area (EEA) and the United Kingdom.

Personal information may be stored, processed or transferred outside the jurisdiction in which it was originally collected, including to Australia, the United States, Canada and other countries where our hosting providers, cloud infrastructure providers, technology providers or service providers operate.

Where applicable, we take reasonable steps to implement safeguards designed to protect personal information transferred internationally, including contractual protections, access controls, confidentiality obligations and security measures appropriate to the nature of the information processed.

By using the App or providing information to us, you acknowledge that your information may be transferred to and processed in countries outside your jurisdiction, which may have different privacy laws from your local jurisdiction.

 

15. DATA RETENTION

 

We retain personal information only for as long as reasonably necessary for:

  1. providing the App and related services;

  2. backup and disaster recovery purposes;

  3. complying with legal obligations;

  4. resolving disputes;

  5. enforcing our agreements; and

  6. legitimate business and operational purposes.

 

While the App remains installed, storefront analytics and tracking data may be retained for up to 12 months and automatically deleted on a rolling basis after that period.

 

Functional App data, including session tokens and remaining analytics or tracking data associated with a merchant store, is deleted following uninstallation of the App in accordance with Shopify’s applicable data deletion requirements and platform policies.

 

Certain limited records may be retained only where reasonably required for legal, regulatory, security, fraud prevention or backup purposes.

 

16. YOUR RIGHTS

 

Subject to applicable laws, individuals may have rights relating to their personal information, including rights to:

  1. request access to personal information we hold;

  2. request correction of inaccurate or incomplete information;

  3. request deletion of personal information in certain circumstances;

  4. request restriction of processing activities;

  5. object to certain processing activities, including certain direct marketing activities;

  6. request portability of certain personal information;

  7. withdraw consent where processing is based on consent;

  8. opt out of marketing communications; and

  9. make a complaint to a relevant supervisory authority or regulator.

 

We will respond to requests in accordance with applicable privacy laws and may require verification of identity before processing requests.

 

Some rights may be limited where exemptions or lawful grounds apply under applicable laws.

 

Where we act solely as a processor on behalf of a merchant, requests relating to end-customer data may need to be directed to the relevant merchant as the primary controller of that information.

 

17. DATA PROCESSING ARRANGEMENTS

 

To the extent applicable under international privacy laws, including the GDPR, merchants using the App acknowledge and agree that:

  1. the merchant generally acts as the controller of merchant and storefront customer data processed through the App;

  2. we generally act as a processor or service provider in providing the App functionality and related services;

  3. we will process personal information only for the purposes of providing the App and related services, complying with legal obligations and improving the App in accordance with this Privacy Policy;

  4. we implement reasonable technical and organisational security measures designed to protect personal information;

  5. we may engage third-party sub-processors, hosting providers and infrastructure providers to support operation of the App; and

  6. we may delete, anonymise or return certain data following termination of services or uninstallation of the App, subject to legal, backup and operational retention requirements.

 

Where required, additional data processing terms may be agreed separately between the parties.

 

18. THIRD PARTY SERVICES AND LINKS

The App and our website may contain links to or integrations with third party services, platforms or websites, including Shopify and other third party tools.

 

We are not responsible for the privacy practices or content of third party services and encourage you to review their privacy policies separately.

This Privacy Policy is governed by the laws of New South Wales, Australia, unless otherwise required by applicable mandatory consumer or fprivacy laws in another jurisdiction.

 

This Privacy Policy should be read together with our Terms and Conditions and any applicable App subscription terms.
